This article seeks to disclose the problem of the government's regulation on the cyberspace. This paper will point out the problem of the regulation in the sociological perspective. There is serious conflict between autonomous norm of netizen and compulsory law of state. The public sphere of cyberspace is based upon the activity of netizen. It is made by the contracts of the netizen and supported by them. This article will argue why the regulation of cyberspace should be based upon the contract rather than compulsory regulation from outside. This study also suggests what type of regulation is suit with the cyberspace. From this point we could discuss what is to be done first before making regulatory law on the cyberspace.
